By accessing or using BidsFactory ("the Service"), operated by Aninver Development Partners, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

BidsFactory is a platform that aggregates and provides access to public tender opportunities, connects experts with organizations, facilitates job postings in the procurement sector, and offers related professional services.

3. User Accounts

3.1 Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription Plans

4.1 Free and Paid Plans

The Service offers both free and paid subscription plans. Paid subscriptions provide access to additional features and capabilities as described on our pricing page.

4.2 Billing and Renewal

Paid subscriptions are billed in advance on a monthly or annual basis. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings.

4.3 Refunds

Subscription fees are generally non-refundable. However, if you cancel within 14 days of your initial purchase, you may be eligible for a full refund.

5. User Content

5.1 Your Content

You retain ownership of content you submit to the Service (including CVs, company profiles, and job postings). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with providing the Service.

5.2 Prohibited Content

You agree not to submit content that:

  • Is false, misleading, or fraudulent
  • Infringes on intellectual property rights
  • Contains malware or harmful code
  • Violates any applicable law or regulation
  • Is defamatory, obscene, or offensive

6. Tender Information

Tender information on the Service is aggregated from public sources for informational purposes only. We make reasonable efforts to ensure accuracy but do not guarantee the completeness or currency of tender listings. Users should verify information with official sources before making business decisions.

7. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by Aninver Development Partners and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

8. Limitation of Liability

To the maximum extent permitted by law, BidsFactory and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Indemnification

You agree to indemnify and hold harmless BidsFactory and its affiliates from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Madrid, Spain.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
